Effective June 1, 2018 , (OTA2018-21) Nasdaq ISE began charging Market Makers a fee for initiating or responding to Flash Orders in Non-Select Symbols, as defined in Section IV.D. (Prior to June 1, 2018, the Exchange waived this fee for Nasdaq ISE Market Makers.) Notwithstanding this change, language in Section IV.G continued to suggest that the Exchange would charge Market Makers no fees in this instance. To eliminate confusion on this issue, the Exchange will cease charging its Market Makers fees for executing Flash Orders in Non-Select Symbols (pending a forthcoming filing to clarify its fee schedule for Flash Orders) and it will rebate all such fees that it has collected since June 1.
