- Effective July 1, 2012, NASDAQ OMX® is adjusting the fee structure of the NASDAQ U.S. Depth Enterprise License for Non-Professionals to $500,000 per month pending approval from the Securities and Exchange Commission (SEC).

What is the NASDAQ U.S. Depth Enterprise License?
NASDAQ OMX makes its full market depth information available to individual investors. As announced in Data News #2010-25, NASDAQ OMX added a NASDAQ U.S. Depth Enterprise License option for Non-Professionals receiving data via broker-dealers. The Enterprise License allows Distributors to cap monthly Non-Professional usage fees for NASDAQ TotalView®, NASDAQ OpenView and NASDAQ Level 2 data.
Note: the Enterprise License covers Non-Professional Subscribers of NASDAQ Depth data entitlements only. Firms must continue to report and pay the applicable usage fees for Professional Subscribers of its NASDAQ Depth products as well as Non-Professional and Professional Subscribers accessing UTP Level 1 data. In addition, firms must also continue to pay the applicable NASDAQ Depth distributor fees.
What is changing?
Since October 2010, NASDAQ OMX has offered a NASDAQ U.S. Depth Enterprise License for Non-Professionals option of $325,000 per month to broker-dealers registered under the Securities Exchange Act of 1934. The new price will be adjusted to $500,000 per month effective July 1, 2012.
What other Enterprise License options are available?
As outlined in the NASDAQ OMX Data Products Price List, NASDAQ OMX offers multiple enterprise license options for its proprietary data products. The enterprise licenses cover different data sets and different customer profiles.
Distributors are encouraged to contact their NASDAQ OMX Global Data Products Account Manager to discuss which NASDAQ Enterprise License option is best suited to its business needs.
