Reminder of NASDAQ OMX eSpeed Market Data Policy for Application Usage

What you need to know:
- As a reminder, eSpeed Market Data is subject to application licensing for firms taking it directly from NASDAQ OMX®, as well as through third-party vendors.
- Effective no later than Monday, June 1, 2014, all firms receiving eSpeed market data must sign the Global Data Agreement (GDA) and have the appropriate application license in place.
What is changing?
In order to reduce confusion and ensure fairness across all clients, effective Monday, June 1, 2014, NASDAQ OMX® eSpeed will implement a universal application license in all cases where eSpeed Market Data is used in software applications and services. Firms will be required to sign and have on file the NASDAQ Global Data Agreement (GDA) and associated Application License Agreement, which outlines the specific terms and conditions allowed for the eSpeed data and associated outputs from this data. Firms who do not comply by Monday, June 1, 2014, may be subject to data feed termination or market data audits.
What activities are subject to the Application License?
The Application License will apply to all non-desktop applications and will specifically reference the business activities the data is used for and customer locations. Please contact your eSpeed data sales representative for further information and support regarding this.
Does my firm need to sign the Agreement if we receive eSpeed Data through a 3rd Party Vendor?
The GDA and Application Licensing agreements are required whether eSpeed data is sourced directly from NASDAQ OMX eSpeed data feeds or through a third-party data provider. Data accessed through third-party vendors may be subject to additional licensing, terms and conditions.
