Nasdaq Releases Version 4.0 of Nasdaq Global Data Agreement and Updated Policy Document

What you need to know:

  • Nasdaq has revised the Nasdaq Global Data Agreement to reflect modified terms for Distributors.
  • Effective immediately, Nasdaq will replace all versions of the Nasdaq Global Data Agreement with Version 4.0.
  • Firms that have already submitted a previous version of the Nasdaq Global Data Agreement are not required to execute a new agreement.
  • Nasdaq has also published updated Nasdaq Global Data Policies.
 

What is changing?

Nasdaq has released version 4.0 of the Nasdaq Global Data Agreement. Please access a redline version here. (Please note that effective October 1st, NASDAQ OMX’s name changed to Nasdaq. This branding change does not impact the legal entity, but you will notice all references to NASDAQ OMX have been replaced with Nasdaq in the Nasdaq Global Data Agreement, in the Nasdaq Global Data Policies and similar updates will continue to be instituted across materials.)

This Data News serves as notification that Nasdaq is altering the terms of the Nasdaq Global Data Agreement. Per its terms, Nasdaq may alter any term or condition of the Nasdaq Global Data Agreement upon notice to Distributor. Receipt or use of the Information referenced in the Nasdaq Global Data Agreement after January 10, 2015, constitutes your firm’s acceptance of the amended terms.

Specifically, Section 22 of previous versions of the Nasdaq Global Data Agreement, states that Nasdaq may alter any term or condition of the Agreement or the Subscriber Agreement on ninety (90) days notice to Distributor, and any use of the Information after such date is deemed acceptance of the new term(s) or condition(s). The means of notifying Distributor of any new term or condition may include, but not be limited to, emailing such term or condition to Distributor or posting such alterations on the Nasdaq Trader website (or a successor site).

Does my firm need to sign a new agreement?

No. In an effort to simplify the paperwork, Distributors are not required to execute the new version of the Nasdaq Global Data Agreement.

What items have been updated in the agreement?

Nasdaq believes the new version of the Nasdaq Global Data Agreement reflects more favorable terms for our customers, including:

  • Minor revisions to the Summary – Section 8 Notifications
  • The addition of clear language regarding banking secrecy regulations in the Terms and Conditions – Section 7 Distributor Audit
  • Revised Definition of Information in Appendix 1

Which Data Policies have been updated?

Nasdaq has updated the Nasdaq Global Data Policies with edits to the clarity of the Delayed Data Timeframes.
