NASDAQ OMX Provides Guidance to PBOT Data Recipients and Distributors

Summary:
- As announced in NASDAQ Vendor Alert #2008-045, in coordination with NASDAQ OMX's acquisition of the Philadelphia Stock Exchange, NASDAQ OMX amended aspects of the market data administration relative to Philadelphia Board of Trade (PBOT) data.
- Depending on how firms receive and/or distribute PBOT data, they made need to take action in order to continue receiving the PBOT data.
Overview:
As announced in NASDAQ Vendor Alert #2008-045, in coordination with NASDAQ OMX's acquisition of the Philadelphia Stock Exchange, NASDAQ OMXSM amended aspects of the market data administration relative to PBOT data.
Depending on how firms receive and/or distribute PBOT data, they may need to complete the following activities in order to continue receiving PBOT data:
- Firms that receive PBOT data via a stand-alone or vendor-controlled terminal do not need to take any action to continue receiving PBOT data.
- Firms that receive PBOT data via a data feed must:
- Complete and submit the NASDAQ Internal Data Feed Recipient Agreement (internal distribution only) or the NASDAQ Distributor Agreement (external distribution), if the firm does not already have the agreement on file with NASDAQ OMX.
- Ensure that the firm has an OLIVER login and password for reporting PBOT usage. To request an OLIVER account, please email the NASDAQ OMX Global Data Products Administration Team.
- Firms that redistribute a PBOT data feed (an uncontrolled retransmission of PBOT data) must:
- Submit a current list of PBOT data feed subscribers to NASDAQ OMX in VARS, VRXML or Excel format.
- Complete and submit the NASDAQ Distributor Agreement (external distribution), if the firm does not already have the agreement on file with NASDAQ OMX.
- Please note that distributors of PBOT data feeds will no longer be responsible for reporting PBOT data feed subscriber usage, as data feed subscribers will report all usage directly to NASDAQ OMX. Distributors of PBOT data feeds are required to report the existence of each PBOT data feed recipient under a non-billable product code. NASDAQ OMX will contract directly with each data feed recipient.
