NASDAQ OMX Provides Clarification on New Global Data Agreement

What is changing?

As announced in NASDAQ Vendor Alert #2008-63, beginning October 1, 2008, NASDAQ OMXSM will no longer accept the following agreements:

  • NASDAQ Distributor Agreement
  • NASDAQ Internal Data Feed Recipient Agreement (formerly NASDAQ Data Feed Subscriber Agreement)
  • OMX Information Distribution Agreement (OMX IDA)

These agreements are being replaced with the new NASDAQ OMX Global Data Agreement.

What are the benefits of this change?

What do I need to do?

If you are a current customer receiving NASDAQ OMX data (NASDAQ, OMX Nordic or Baltic, NASDAQ OMX PHLX data), you must complete and submit the Summary Section of the new NASDAQ OMX Global Data Agreement to NASDAQ OMX by January 1, 2009.

If you are a new customer ordering NASDAQ OMX data, you must complete and submit the following documents:

 

Do I need to submit the entire Global Data Agreement?

No, customers are only required to submit the Summary Section (four pages) of the NASDAQ OMX Global Data Agreement.

Do I need to submit the Global System Application and/or the Data Feed Request Form?

Existing customers that already have a System Description or Attachment A on file with NASDAQ OMX do not need to complete the Global System Application, nor the Data Feed Request Form.

New customers ordering NASDAQ OMX data for the first time are required to complete both the Global System Application and the New Data Feed Request Form.

My firm receives NASDAQ OMX data on a data feed, but only uses the data internally. What do I need to submit?

If your firm receives NASDAQ OMX data via a data feed product, you must complete and submit the NASDAQ OMX Global Data Agreement. Previous versions of the NASDAQ Internal Data Feed Recipient Agreement and the NASDAQ Data Feed Subscriber Agreement are being replaced with the new global agreement.

I receive my data through a stand-alone terminal. What do I need to submit?

No action is required for any NASDAQ OMX data received via a stand-alone terminal.

My firm only receives UTP Level 1 data on a data feed. What do I need to submit?

If your firm only receives UTP Level 1 on a data feed, you do not need to submit anything at this time. Your current NASDAQ Vendor Agreement is still valid. If you do not have a NASDAQ Vendor Agreement on file with NASDAQ OMX, please complete and submit this agreement to NASDAQ OMX by January 1, 2009.

How do I submit the Global Data Agreement?

Submit two completed copied of the NASDAQ OMX Global Data Agreement by January 1, 2009, by:

    1. Emailing scanned copies to DataAdmin@nasdaqomx.com

    2. Faxing them to +1 301 978 5295

    3. Mailing them to: NASDAQ OMX Global Data Products, 9600 Blackwell Rd., Suite 500, Rockville, MD 20850, USA

What happens if I do not submit the Global Data Agreement to NASDAQ OMX by January 1, 2009?

For organizations that do not execute and submit the Summary Section of the NASDAQ OMX Global Data Agreement by January 1, 2009, NASDAQ OMX will assume that the data feed services have been canceled and will process the account accordingly.
