Reminder: NASDAQ OMX Global Data Agreement Due January 1, 2009

Summary:
- As announced in NASDAQ Vendor Alert #2008-65, as of October 1, 2008, NASDAQ OMX no longer accepts the following agreements:
- NASDAQ Distributor Agreement
- NASDAQ Internal Data Feed Recipient Agreement (formerly NASDAQ Data Feed Subscriber Agreement)
- OMX Information Distribution Agreement (OMX IDA)
- Recipients of NASDAQ OMX data feeds (NASDAQ, OMX Nordic or Baltic, NASDAQ OMX PHLX) must now complete and submit the Summary Section of the NASDAQ OMX Global Data Agreement.
- Current datafeed customers must submit an executed Summary Section by January 1, 2009, in order to continue service.
- New datafeed customers must submit an executed Summary Section for any datafeeds ordered on or after October 1, 2008.
Overview:
As announced in NASDAQ Vendor Alert #2008-65, as of October 1, 2008, NASDAQ OMXSM no longer accepts the following agreements:
- NASDAQ Distributor Agreement
- NASDAQ Internal Data Feed Recipient Agreement (formerly NASDAQ Data Feed Subscriber Agreement)
- OMX Information Distribution Agreement (OMX IDA)
These agreements are being replaced with the new NASDAQ OMX Global Data Agreement.
Customer Obligations:
Recipients of NASDAQ OMX data feeds (NASDAQ, OMX Nordic or Baltic, NASDAQ OMX PHLX) must now complete and submit the Summary Section of the NASDAQ OMX Global Data Agreement.
Current customers must submit an executed Summary Section by January 1, 2009, in order to continue service. If NASDAQ OMX does not receive this paperwork from your organization by January 1, 2009, NASDAQ OMX will assume that your organization has canceled service and will process your account accordingly, which may involve disconnection of NASDAQ OMX proprietary service.
New customers must submit an executed Summary Section for any datafeeds ordered on or after October 1, 2008.
Also note that the NASDAQ OMX Requirements, market data polices and/or prices that are in effect at the time of receipt of the data apply and will be used as the basis for any audit findings.
