NASDAQ OMX Global Data Products Introduces New Global Data Agreement and Revises Other Agreements

Summary:

  • NASDAQ OMX is introducing the NASDAQ OMX Global Data Agreement and revising its other current documentation to reflect The Nasdaq Stock Market, Inc.'s combination with OMX AB and its name change to The NASDAQ OMX Group, Inc. ("NASDAQ OMX").
  • In order to streamline the ordering process, NASDAQ OMX will now offer a single agreement for NASDAQ OMX data feed recipients.
  • As of today, September 2, 2008, NASDAQ OMX will replace all versions of the NASDAQ Distributor Agreement, the NASDAQ Data Feed Subscriber Agreement, the NASDAQ Internal Data Feed Recipient Agreement and the OMX Information Distribution Agreement with the NASDAQ OMX Global Data Agreement.

 

Overview:

NASDAQ OMXSM is introducing the NASDAQ OMX Global Data Agreement and revising its other current documentation to reflect The Nasdaq Stock Market, Inc.'s combination with OMX AB and its name change to The NASDAQ OMX Group, Inc.SM ("NASDAQ OMX").

New Global Data Agreement:

In order to streamline the ordering process, NASDAQ OMX is now offering a single agreement for NASDAQ OMX data feed recipients. As of today, September 2, 2008, NASDAQ OMX will replace all versions of the NASDAQ Distributor Agreement, the NASDAQ Data Feed Subscriber Agreement, the NASDAQ Internal Data Feed Recipient Agreement and the OMX Information Distribution Agreement with the NASDAQ OMX Global Data Agreement.

This new Agreement reflects the corporate name change and harmonizes the policies surrounding the distribution of NASDAQ OMX Information. Further, as a result of other recent acquisitions, data from the NASDAQ OMX PHLXSM (formerly The Philadelphia Stock Exchange), The Boston Stock Exchange (which will be renamed NASDAQ OMX BXSM) and NASDAQ OMX Europe is also covered by this new Agreement. This new Agreement will cover all NASDAQ OMX information, as described in Appendix 1 of the Agreement.

Changes to New Global Data Agreement:

While the merger primarily affected the legal status of NASDAQ OMX, as opposed to a change in the way NASDAQ OMX will operate, such a change does require that NASDAQ OMX revise its legal agreements and forms to reflect the change in name. The following documentation has been updated with our new name, The NASDAQ OMX Group, Inc:

Customer Obligations

  • New NASDAQ OMX Data Feed Recipients - New NASDAQ OMX data feed recipients should complete and submit the new NASDAQ OMX Global Data Agreement. Previous versions of the NASDAQ Distributor Agreement, the NASDAQ Data Feed Subscriber Agreement, the NASDAQ Internal Data Feed Recipient Agreement and the OMX Information Distribution Agreement will no longer be accepted.
  • Existing NASDAQ OMX Data Feed Recipients - All existing NASDAQ OMX data feed recipients will eventually be party to the new agreements. However, no action is required at this time. Additional details and instructions will be provided in the coming weeks.
  • End-User Subscribers - Current subscribers to stand-alone data products are not affected at this time.
