Market Exemption Policy

Overview

To file a Market Exemption request for the Nasdaq PHLX complete and submit and the Market Exemption Filing Form.

When filing your request, please ensure that your requests are timely, all required fields are populated with accurate information and attached documentation (if any)relating to your request. Incomplete filings will be denied automatically.

Market Exemption Request Guidance

A Nasdaq PHLX Options Exchange Official (OEO) will review all Market Exemption requests on a case by case basis to determine whether to approve or deny the requests.

A Nasdaq PHLX OEO will review requests based upon the events that include, but are not limited to those on the following list, or any other unusual market events as determined by the OEO:

  1. Market volatility;
  2. Exchange related and/or Firm proprietary system problems;
  3. Corporate actions, delayed openings, or trading halts in the underlying stock; and
  4. News relating to the underlying stock

Filings Deadline

Filings must be received promptly, either during or immediately following the event.

Requests for market exemption relief received after 30 mintues of the commencement of an event (if approved) shall begin at the time of receipt of the request.

Requests for market exemption relief received 30 minutes after the event has occurred will be denied automatically, unless specific details are provided regarding the request and why the request was submitted late.

Documentation

If a relief request is based upon news and/or market volatility, please provide any necessary documentation that will assist the Nasdaq PHLX OEO in reviewing your request.
