Updates and Clarification on Nasdaq Global Index Data Products

What you need to know:

  • Nasdaq has issued updates to its Global Index Data Usage and Distribution Policy (“Policy”).

  • As of September 1, 2026, GIDS Delayed Data will no longer be available to new clients.

  • No immediate action is required for existing clients of GIDS Delayed Data.

  • Nasdaq issued an updated policy on November 11, 2025, to clarify that the use of index data for benchmarking investment products requires Nasdaq approval and appropriate licensing. This policy is currently in effect and applies to existing and future licenses.

  • Additionally, as a reminder, firms are strictly prohibited from creating investment products from GIDS information without express written approval from Nasdaq.

What is changing?

For New Clients:

  • GIDS Delayed Data will no longer be offered as a licensing option as of September 1, 2026.
  • As an alternative, clients can leverage Real-Time or End-of-Day (EOD) offerings for index data access.

For Existing Clients:

  • Current GIDS Delayed Data licenses will remain in effect. No immediate action is required.

What actions does my firm need to take?

  • Firms should review the Policy to ensure their use of index data adheres to the Policy requirements, including:
    • Restriction on Creation of Investment Products. Index information may not be used in connection with creation of investment products without appropriate licensing from Nasdaq, including, but not limited to, use of index data in perpetual futures, tokens and event contracts.
    • Performance Benchmarking License Requirements. Indexes and other index related information may not be used for performance benchmarking of investment products without proper authorization and licensing by Nasdaq.
  • Clients seeking to use index data for investment products, including but not limited to performance benchmarking, should contact your Nasdaq sales representative to discuss licensing arrangements.
  • If you are uncertain about whether your use case includes performance benchmarking, please contact your Nasdaq sales representative. This team will provide the necessary information.
