What you need to know:

  • NASDAQ OMX BXSM (BXSM) has announced a New Annual Administrative Fee.
  • The new fee has been approved by the Securities and Exchange Commission (SEC) as a component of the BX Rulebook and is effective as of 2010.
  • The once-annual fee will be included in the September 2010 invoice.

What is the fee schedule for the BX Annual Administrative Fee?

BX distributors will be assessed an Annual Administrative Fee as follows:

Service Level Annual Administrative Fee (per year)
Delayed Distribution $ 500
Real-Time Distribution $ 1,000

Each organization will pay only one BX Administrative Fee each year, the timing of which is dependent on the BX data feed service received by the organization:

  • Delayed Administrative Fee — Distributors only receiving delayed BX data feed services from retransmission vendors

  • Real-Time Administrative Fee — Distributors receiving real-time BX data feeds in addition to potentially receiving delayed data feed services

Distributors receiving real-time and delayed data feed services shall only be liable for the Real-Time Administrative Fee.

What is the effective date of the new BX Annual Administrative Fee?

NASDAQ OMX® will begin charging the BX Annual Administrative Fees as applicable to market data recipients in 2010. As these fees are invoiced directly by NASDAQ OMX, the new rates will automatically be reflected in the invoice for the service month of September 2010.

Beginning in 2011, distributors will be billed for this fee in the January invoice.
